Terms of Service

This is a translation for your convenience. In case of any discrepancy, the Spanish version prevails.

1. Who provides the service

The service offered at www.empyrialms.com under the trade name Empyria (also “Empyria LMS”) is provided by:

The owner provides the service personally until the company that will continue it is incorporated; this page will be updated when that happens. In these terms, “Empyria”, “we” or “us” means the owner; “the client” is the academy, institution or person that hires the service; and “users” are the client’s students, teachers and contacts.

2. Acceptance

By hiring the service (for example, by completing the sign-up at www.empyrialms.com/alta.php) or by connecting an Instagram, Facebook or WhatsApp account to the Empyria LMS app, the client accepts these terms, the Legal Notice and the Privacy Policy. If you do not agree, do not use the service.

3. What the service includes

Empyria provides, under the client’s brand and on the client’s own domain:
  • Virtual campus: courses, memberships, assessments, certificates, student payments and website.
  • Marketing module: contact CRM, automations, email campaigns, funnels and integrations.
  • Meta integration (“Empyria LMS” app): lets the client connect their professional Instagram account (and, when available, their Facebook Page and WhatsApp Business number) to receive and reply to messages and comments from their dashboard, and to automate replies that the client configures.
  • Hosting, technical maintenance, updates and support, according to the plan.

4. Sign-up, prices and payments

The service is paid monthly in advance, in US dollars or the equivalent in Argentine pesos at the exchange rate shown at checkout. Payments are processed by:
  • Mercado Pago: the charge appears under the owner’s name, Ramón Osvaldo Correa.
  • PayPal: the charge appears under the name Empyria LMS.

Empyria does not store card details: Mercado Pago or PayPal process them. There is no minimum term: the client can cancel at any time and stops paying from the following month. The month already paid is not refunded, except as stated in section 5. Prices may change with at least 30 days’ notice; Founders Program clients keep their price for the period promised at sign-up.

5. Right of withdrawal

If the client hires as an end consumer, they may withdraw within 10 calendar days of payment, without giving reasons and at no cost, under article 34 of Argentine Consumer Protection Law 24,240. Just write to info@empyrialms.com or via WhatsApp; the amount is refunded through the same payment method.

6. Client obligations

The client agrees to:
  • Own, or be authorized to use, the accounts, domains and content they connect or upload.
  • Publish only their own or authorized content and comply with the law applicable to their educational and commercial activity.
  • Process their students’ and contacts’ data under the applicable data protection law (in Argentina, Law 25,326) with a valid legal basis. The client is the controller of that data; Empyria acts as processor on the client’s behalf.
  • Send marketing emails only to people who consented, and honor unsubscribes (the module adds an unsubscribe link to every email).
  • Use Instagram, Facebook and WhatsApp in line with Meta’s Community Standards and Terms: no unsolicited messages or spam, respect the 24-hour messaging window, and never use the integration to harass, deceive or collect data without permission.
  • Keep their passwords and the module’s API tokens confidential.

7. Meta integration (Instagram, Facebook and WhatsApp)

The Empyria LMS app connects to the client’s account only when the client authorizes it, by logging in with Meta from their dashboard, and only with the permissions accepted at that moment. With that authorization, Empyria may: receive the direct messages, comments and mentions of the connected account; send the replies the client writes or has set up in their automations; and read the username and public name of the person writing.

Empyria never posts on its own, never sends messages the client has not written or configured, does not sell or share the data it receives from Meta, and does not use it for its own purposes or for advertising. The client can disconnect the account at any time from their dashboard or from their Instagram or Facebook settings (Apps and websites). How that data is handled and how to request its deletion is explained in the Privacy Policy. Use of Meta products is also governed by the terms of Meta Platforms, Inc.

8. Availability and support

Empyria makes reasonable efforts to keep the service running continuously, with backups and tested updates. It cannot guarantee 100% availability, since it also depends on hosting providers, Meta, Mercado Pago, PayPal and other third-party services. Planned downtime is announced in advance whenever possible. Support is provided by email, WhatsApp and from the campus dashboard.

9. Intellectual property

Empyria’s software (campus, marketing module and Empyria LMS app) is the owner’s own development. Hiring the service grants the client a right of use, not ownership of the software or access to its source code. Content uploaded by the client (courses, texts, videos, brand) belongs to the client: Empyria only hosts and displays it to provide the service.

10. Suspension and cancellation

If payment is not received, the service may be suspended until it is settled. Empyria may also suspend an account used for illegal activities, for spam or in breach of Meta’s policies, notifying the client whenever possible. After cancellation or suspension, the client’s and their students’ data are kept for at least 12 months so they can be recovered or exported; after that they are deleted. When Instagram, Facebook or WhatsApp is disconnected, the access token is deleted immediately.

11. Liability

The client is solely responsible for the content they publish, the messages they send or automate, their relationship with students and contacts, and compliance with the rules of their activity. To the extent permitted by law, Empyria’s liability is limited to the amount paid by the client in the last three months of service. Nothing above limits the rights granted to consumers by Law 24,240.

12. Changes to these terms

These terms may be updated to reflect changes in the service or the law. The date of the last update is shown above. Material changes will be notified to clients by email at least 15 days in advance.

13. Governing law and jurisdiction

These terms are governed by the laws of the Argentine Republic. Any dispute shall be heard by the ordinary courts of the city of Rosario, Santa Fe, unless the client is a consumer, who may choose the courts of their own domicile.
